Afton Marina & Yacht Club Inc. Marina Rules

A. SAFETY

1. All boats must conform to U.S. Coast Guard and State safety requirements.

2. Afton Marina & Yacht Club, Inc., has the authority to “RED-TAG” any boat whose mechanical or electrical condition may cause property damage or personal injury. No operation of the engines or movement from the slip is allowed until the condition has been corrected and approved by the Service Manager or General Manager.

3. Members/Lessees must promptly report to management any unsafe or hazardous condition. After business hours, Marina Security must be advised via Channel 16 on VHF radio.

4. Engine compartment blowers must be operated at least four(4) minutes before starting engines. “Sniffers” are strongly recommended.

5. Propane or electric grilling is allowed on boats. However, charcoal grilling on boats is prohibited. Grilling of any type is prohibited on any dock finger or head pier.

6. Fireworks of any kind are prohibited anywhere in the marina.

7. Water hoses, electrical cords, lines, and other material may not extend across head piers, and slip fingers must be kept clear of hazards.

8. When the boat is unoccupied for more than eight(8) hours, air conditioners must be turned off.

9. Small children must wear life jackets while on slips and head piers unless accompanied by a responsible adult.
10. Swimming and use of rafts and floating chairs in the marina are prohibited.

B. FUELING

C. BOATS, MOORINGS & OPERATION

1. All boats must be moored securely, properly and safely, and sailboat halyards must be secured so they don’t clang against the mast.

2. Generally the maximum distance by which any boat (including all projections such as transom, platforms, booms, bait tanks, davits, bow sprints, or other projections) may extend beyond the end of the slip shall be 10% of the length of the slip.

3. Main engines shall not be operated in gear while the boat is secured in the slip, nor at idle any longer than necessary for warm-up purposes.

4. Boats backing from slips, and boats leaving the marina have the right of way. Boats leaving the marina must maintain a safe distance between each boat, and no passing is allowed upon entering or leaving.

5. Boats (large and small), including jet skis, operated in or near the marina must be operated at a “no wake” speed. Ordinarily, unless wind conditions require higher velocity for safe steerage, “no wake” means closed throttle.

6. Any sailboat must be under controlled power (not wind power) when entering, operating in, or leaving the marina.

7. Each Member/Lessee shall be responsible/liable for any damage to other boats or property (personal or marina), and proof of liability insurance coverage of at least $500,000 for each primary and secondary boat and personal watercraft must be provided to the marina office upon occupancy and each year prior to spring launch.

8. Operation of small boats in the marina must be in compliance with State Law, and must not interfere with larger boat traffic.

D. SECONDARY BOATS & PERSONAL WATERCRAFT

(defined as Overall Length of 20’ or less)

1. The current DNR ruling states that Afton Marina & Yacht Club, Inc., is allowed one boat per slip. Any watercraft that can be raised out of the water and attached to the owner’s boat, and does not exceed the 10% foot extension limit of the slip is legal per the DNR restrictions.

2. Secondary boats, personal watercraft and toys are not allowed in slips, on dock fingers or head piers, tied to the dock, or supported by any type of lifting device on the dock.

3. Members/Lessees electing to place a watercraft in their slip which is in direct violation of the marina’s permit will be personally responsible for all fines incurred by either the Member/Lessee or the Marina due to his or her actions.

4. The owner of the secondary boat, personal watercraft or toy must be the Member/Lessee.

E. SLIPS,CONSTRUCTIONS, COVERING & COMMON DOCKWAYS

1. All electrical cords that run from a supply box located on the dock to the boat must have a locking and grounding design to prevent accidental disconnect. Power cords must meet the standards for 30 amp service exterior use.

2. He cost of increased power and outlets beyond the normal electrical service provided by the marina, and installation, is the responsibility of the Member/Lessee, and must have approval of the Board of Directors in writing.

3. A charge for repairing electrical boxes damaged due to overload or improper hook-up will be assessed to the responsible party.

4. Members/Lessees may not alter slips or adjacent common dockways, electrical or water service facilities, including painting and carpeting.

5. Dock boxes, boarding ladders, hose reels, benches, and other dock attachments must be purchases from an approved vendor’s model list, and installed in accordance with marina specifications.

F. CONDUCT

1. Members/Lessees must conduct themselves with consideration for others and are responsible for their children’s and guests’ conduct.

2. Running or riding bicycles on slips and common dockways is prohibited.

3. Conduct that involves risk or injury to persons or property is prohibited.

4. Illegal or inappropriate conduct is prohibited.

5. Marina quiet time is between 11:00 pm and 8:00 am.

6. Animals, when off boats, must be leashed and areas near each dock entrances are not to be used as relief stations. Animal owners are responsible for pick up waste after their animals and for proper disposal of the waste to keep our lawns and grounds clean.

7. Animals must not disturb Members/Lessees of their guests, or constitute a nuisance.

G. SECURITY

1. Any non-owner who is captain or crew-member living on board a boat in the marina must be registered with the marina office.

2. Lessees must submit a signed lease to the marina office prior to date of occupancy.

3. The marina office is required to have keys to each Member’s/Lessee’s boat for the purpose of accessing or moving the boat in order to protect personal property of an individual or the marina. Access to the boat will only be allowed in an emergency or when the Member/Lessee could not be notified to correct the problem.

4. Marina management will only release Member’s/Lessee’s boat keys per “BOAT KEY DISTRIBUTION AUTHORIZATION FORM” to an Afton Marina approved vendor.

H. PARKING & SUMMER STORAGE

1. Vehicles must not be parked directly in front of dock ramps.

2. RV/Motor homes exceeding 24’ in length may not be parked on marina property. Vehicles 24’ or less may occupy only one standard space, may not be occupied overnight, may not leave generators running overnight, may not leave generators running while parked, and may not be connect to marina power boxes.

3. Summer boat storage is limited to Secondary Watercraft only (please refer to Section D. Secondary Boats and Personal Watercraft).

4. Members/Lessees desiring summer storage of trailers and Secondary Watercraft must register them with the marina office annually, so they can be specially marked and parked in the trailer storage area. Trailers and Secondary Watercraft which are not properly registered, marked, and parked will be confiscated.

I. PAYMENTS

J. POLLUTION

1. No one may throw or discharge into the marina: garbage, paper waste, oil, raw sewage, gasoline or diesel fuel, cans, bottles, cups, or any other material which will pollute the water.

2. All boats must be equipped with U.S. Coast Guard approved waste storage systems.

3. Boat work involving mechanical repair, scraping, sandblasting, or painting must be authorized by management and accomplished in compliance with EPA standards for ground protection and clean-up.

4. Port-a-potties may only be emptied at the gas dock waste area. Emptying them in the rest rooms is strictly prohibited.

K. COMMERCIAL ACTIVITIES

1. Offers to sell, or solicitations of orders for goods, wares, merchandise or services is prohibited.

2. Members shall not post or permit posting by any persons or commercial entities upon their boats or slips for solicitation of business (excluding “For Sale” signs).

3. All prospects/clients must be accompanied by the owners and/or brokers on all boat and/or slip showings.

4. All charter/commercial operations must obtain an annual SPECIAL USE PERMIT through the Board of Directors prior to beginning any activity. No charters are to originate or terminate from the marina, and customers must board and disembark at a location outside the Marina common areas.

5. No signs shall be posted in the Marina with a commercial owner’s name directing customers.

L. SUGGESTED GUIDELINES

These Rules are binding on all Members, Lessees, family members and guests. By authority of the Board of Directors, Rule violations will result in appropriate fines and/or penalties. Exceptions to these Rules must be approved in writing by the Board of Directors.
